What effects can the addition of an additional partner within the framework of a group practice or a takeover of a practice have on the rent? The landlord of business premises is entitled to an increase in rent up to the appropriate main rent if the main tenant sells or leases the business operated in the business premises for continuation in these premises or – if the business premises have been leased to a legal entity or a partnership under commercial law (e.g. OG, KG, etc.) – the legal and economic influence of the tenant changes decisively. However, this provision only applies to certain properties. The article deals with practical cases of application.
